Updated as of 3:48 Aug. 8 to include Kelly's suspension information.
James Tyler Kelly, assistant principal at Southern Alamance Middle School, has been arrested for alleged misconduct with a student.
Kelly was charged with one count of felony sex act with a student and his bond was set at $50,000, according to a statement by the Alamance County Sheriff’s Office. Kelly was also notified on Aug. 8 that he will be suspended without pay.
Investigators determined the incident did not occur on school property.
This follows a similar incident in May where Ivan Danilo Ardila-Perez, former Southern Alamance Middle School Spanish teacher and soccer coach, was charged with two counts of indecent liberties with a student and two counts of indecent liberties with a child.
Kelly has been employed by Alamance-Burlington School System since 2011 and has worked in elementary, middle and high schools — most recently as assistant principal at Southern High School.
Les Atkins, ABSS public information officer, wrote in an email to Elon News Network that ABSS is cooperating with law enforcement’s investigation.
“Any victim of misconduct will be treated with compassion and concern,” Atkins wrote. “We remain fully committed to student safety, transparency and maintaining a caring, supportive learning environment for all.”
